On the website, you can get information pertaining to who’s holding the Punjab RERA office, services rendered to promoters, Real Estate Agents, Citizens. You may also access the Real Estate (Regulation and Development) Act 2016, Real Estate (Regulation and Development) Rules  Punjab, RERA Punjab General Regulations.

The Punjab RERA or P-RERA in short comes with the facility of the online registration both for projects and agents.

Complaints can be made both to RERA Authority as well as Adjudicating Officers.

RERA is applicable only to projects registered with Punjab RERA as dictated in the judgment Bikramjit Singh & Ors. Case 3 of 2017 decided on 13.12.2017 that says complaint not maintainable, since the project is not registered.

Salient Features of the RERA Act:

1 Sec 85 covers all the projects registered with the RERA Authority.

2 Sec 99 deals with the projects not registered with the RERA.

3 Under Sec 59 of RERA Act, notice can be sent to promoters for non registration of project with the authority and heavy penalty can be imposed thereof in lieu of non compliance of RERA Act.

4 There can be exceptions for the projects where exemption is granted under Sec 3 of the Act.

5 Application can be made to RERA Authority or Adjudicating officers under Sec 31 of the Act.

6 Under Section 36- Interim Orders can be granted, Section 37- Power of Authority to issue Directions, Section 44- Application to Appellate Tribunal, and Section 58- Appeal to High Court.

7 The complainant can withdraw the pending complaint under section 71 of the RERA with permission to file it before the authorities.

8 RERA Authorities have got the power to summon and enforce attendance of any individual acquainted with the facts of the case.

9 Complaint under Sec 31 with Form M- RERA Authority and Form N- Adjudicating Officer, Under Section 44(1) Form L- Appeal to Appellate Tribunal. In the act itself, you can find rates of registration for the promoter and Agreement for sale sample. Forms should be given in triplicate.

10 RERA works on the basis of carpet area whereas earlier disputes were adjudicated on the basis of carpet area, super built-up area & built up area.

11 As per RERA, now builders can make changes only upto 5% in the sanctioned plans. RERA also fixes the interest payable by the promoter to and the allottee which is State Bank of India Marginal Cost of Lending Rate plus 2%. RERA also provides provision for compensation or recovery of interest, penalty & compensation as arrears of Land Revenue.

12 Complainant can authorize any person or RERA Advocate/Lawyer/Legal Advisor/Attorney in Chandigarh Panchkula Mohali for the smooth disposal of the rera complaint.

13 RERA provides penalty and offences under various sections of the Act.

  • u/s  59 (2)- 10% of cost of ongoing project.
  • u/s  64 – 10 % of Flat/Apartment basic price.
  • u/s 66- 10% of building in question
  • u/s 68- 10% of the estimated cost of building.

14 Compounding of offences is also permissible under the provisions of RERA Act within 30 days.

15 RERA also provides for penalty and interest against the buyer/purchaser and agents registered as well as non-registered of the plot in the same manner under sections 60, 61, 62, 63, 64, 65, 66, 67 of the Act.

16 Section 72 talks about the factors taken into account by Adjudicating officer before adjudging the claim under Section 71

  • Amount of Disproportionate gain as a default.
  • Amount of loss caused.
  • The repetitive nature of default.
  • Any other factors which Adjudicating officer considers for furtherance of the justice.

Complaint before Authority (Real Estate (Regulation and Development) Rules Punjab- Rule 36 Form M with Rs 1000 Fee in form of DD or Cheque in name of the authority)

1 The complaints regarding contravention of rules, act and regulations can be made to the authority.

2 As per act, the nature of complaints which Adjudicating officer cannot hear are put before the Authority.

Complaint before Adjudicating Officer (Real Estate (Regulation and Development) Rules Punjab -Rule 37 Form N with Rs 1000 Fee in form of DD or Cheque in name of the authority)

1 The Adjudicating officer need to decide the compensation or interest claims within 60 days of the receipt of complaint. In case of extension of this period, he has to record the reasons for doing so.

2 The complainant can claim interest and compensation under sections 12, 14, 18 & 19 of the Act.

  1. Section 12- Obligation of promoter regarding Ad’s Veracity.
  2. Section 14 -Adherence to sanctioned Plans and project specification by promoter.
  3. Section 18 -Return of Amount & Compensation
  4. Section 19- Rights & Duties of Allottees.
