The most sought after skill for any newcomer in legal field is Legal Drafting and nobody teaches you the practical side of it in Law School. So that void must be filled before you join the profession.

Maintainability, Limitation, Cause of Action, Court Fees, Proper Parties, filing under the correct section, Jurisdiction, Any previous petition or Legal Respresentation etc. You should be current, updated with the latest position of law. There is no substitute for this.

3 Notes– Capture the right information with zero errors otherwise you will be wasting money and time too. Also it will show your incompetence to file it rightly at the first instance. So be professional and serious while making notes and noting the information rightly. For e.g. name of the person, place, time, dates are most important.

4 Formatting– Follow one formatting for all so that you don’t have to remember for any particular one. For example, I usually follow High Court formatting for all my case drafts which is Times Roman, 14 size with double spacing and margins as desired. Top court formatting is always accepted by lower crafts.

5 Sequence– Write a perfect story from Day 1 to Day last, so that one should be able to read out your entire tale in just few minutes. What happened when and what is it now you want. It is that simple.

6 Prayer– The heart of drafting. It should be clear and unambiguous. You will not get what you have not written in the prayer clause. So take time on it and draft carefully with utter precision and logical mind. If you leave anything here, then you have to start from the scratch by amending the petition.

7 Index and Proof read– Last and the most important of all is the index with right annexures names and page numberings. This involves a good amount of time as you have to get the photocopy sets ready. If you do it right then you won’t be wasting the money otherwise it is going to be re-work for you.

Rest everything is secondary, Tickets, urgent form, true copy at the annexures. I have not covered the interim applications, exemption or condonation application as it is the part of knows the law point.

So in my view, Legal Drafting is a craft which one masters only with practice otherwise it is skill, not to be learnt but physically done.
