Appeal to Haryana Real Estate Appellate Tribunal at Chandigarh

Haryana Real Estate Regulatory Authority (RERA) has already set up an Appellate Authority for appeals arising out of the decisions of Haryana RERA Authority benches constituted at Gurugram and Panchkula is being headed by retired Justice Darshan Singh which is now fully functional.

Update– The news of Haryana Government to constitute an Appellate Tribunal in Karnal is no longer applicable to hear appeals of allottees not satisfied with the decisions RERA Authorities of Panchkula and Gurugram. So, you can ignore this post found online.

Time Limit for Appeal– Sec 44 (2) of the RERA Act, 2016 stipulates 60 days for appeal to RERA Appellate Tribunal and further second appeal to Punjab and Haryana High Court at Chandigarh.

Appeals may be accepted beyond the period of 60 days in case the courts feels it appropriate.

Fee for Appeal– Rs 1200/- approx and rest it can increase with no. of annexures and affidavits.

The Haryana RERA Appellate Authority came into existence on the intervention of Punjab and Haryana High Court in case named Emmar MGF Land Ltd vs. State of Haryana and Ors on decided on 20.08.2018.

The State of Haryana has constituted the Appellate Tribunal to hear appeals as per first proviso to Section 43(4) of the Real Estate (Regulation and Development) Act, 2016. The judgment can be read here.

The presence of institutional mechanism for redressal of genuine grievances of homebuyers through appeals bolsters the foundation of Real Estate sector in India and brings more transparency along with discipline in builders. So, in case the home owners feel that the decision of RERA Panchkula or RERA Gurugram Authority is harsh or against their interest, they can very well approach the Haryana Real Estate Appellate Tribunal constituted at Chandigarh.

The format of Appeal is entirely different from that of complaints to Haryana RERA Authority which is currently being filed online and complaint number is also generated for the same. For your ready reference you can refer form ‘L’ for Punjab RERA Appellate Authority and form ‘AAT’ for Haryana RERA Appellate Authority.

Legal Provisions for Appeal:

Sec 44 of the Real Estate Regulation and Development Act, 2016 provides procedure for appeal to Appellate RERA Authorities for state of Punjab and Haryana.

Rule 22 of Haryana Real Estate Regulation and Development Rules, 2017 provides the entire scheme of appeal and what needs to be appended while applying for it.
