CBI : Central Bureau Of Investigation.

CBI is an investigating agency.

It operates under Ministry Of Personnel Public Grievance And Pensions Of India

CBI investigate special crimes ,high profile cases, economic crimes and cases of corruption.

CBI is headed by a Director , IPS officer.

Director is selected for two years by CVC act.

There are other staff members also who are IRS,IPS officer, A Senior Superintendent of police, Deputy Inspector General Of Police , Additional Superintendent Of Police , Deputy SuperintendentOf Police , Inspector , Sub Inspector , Assistant Sub Inspector , Head constable , Constable.

CBI headquarters are located at Delhi.

CBI training academy is in Ghaziabad.

Powers Of CBI.

DSPE Act , 1946 gives legal powers of CBI related to investigation.

To maintain law and order is police’s responsibility.

However CBI may investigate cases containing –

  • Offences against Central Government affairs and employees.
    • Where financial interest of Central Government is involved.
  • Where there is breach of Central laws.
  • Where there is fraud or crime in two or more states.
  • International cases.

High Court and Supreme Court can order CBI to investigate an offence.

In simple language what cases can be referred to CBI are:

  • Corruption cases of Union Government.
  • Union Government , CBI and concerned State Government agrees that case is to be given to CBI.
  • If High Court or Supreme Court on request of citizen direct transfer of case from police to CBI.

Process Of CBI.

When a complaint is received by CBI first step is inquiry.

When a FIR is made of a cognizable offence and CBI initiate the proceedings.

Section 3 of the DSPE act gives power to investigate case to CBI officer.

CBI can investigate case in any territory of India either in any State or Union territory.

Consent cannot be revoked.

 

Process Of Investigation OF CBI.

Investigating officer will make a plan for investigation.

He will see the allegations that are reported in FIR .

Then he will list the important allegations and other allegations which are not so important.

Then along will Superintendent Of Police , Investigating officer will see how they have to carry  investigation.

Plan Of Investigation.

List of things to do in Plan Of Investigation are

  1. All important allegations of FIR should be proved.
  2. Examination of witness should be done.
  3. Seizure of documents.
  4. Opinions of expert must be taken.
  5. Search to be done.
  6. Any inquiry if required to do outside India.

This list of things in plan of investigation are not final and can be altered by both Investigatingofficerand Superintendent of police

 

Then CBI officer will go to the place where crime was committed.

From there they can collect evidences.

This step is most important.

Investigating Officer can take pictures of scene or can video tape it or can take any step to trap the evidence.

Investigating Officer with approval of Superintendent Of Police can take advice and help from any officer of any department.

Investigating Officer will then arrest the suspected person.

Then after arrest he has to collect evidences of people , record their statements , collect documents and can also seize the place for investigation.

No use of coercion should be there while recording statement and taking of evidences.

Then expert opinion must be taken.

Then Investigating Officer will see that whether there is reasonable doubt and accused should be placed before Magistrate.

Then chargesheet will be filed and accused will be brought before jurisdictional court.

Powers Of Investigating Officer.

Police officials above officer rank can investigate cognizable offences.

Similarly Investigating Officer can investigate cognizable offence or can direct his subordinate to do so.

Investigating Officer can summon persons for investigation.

They can record statements of witnesses.

If accused person escapes from the country then investigation can be carried abroad by CBI.
