ELECTRICITY DEPARTMENT TO PAY RS.10,000 FOR ERRONEOUS CHARGING FROM MAN DEMANDED INSTALLATION OF A 3-PHASE METER
Nareshjith Singh had requested the Electricity Department (ED) for change of a 2phase meter to a 3phase one due to increase of load. He had paid the processing fee of RS.25 and the service connection charges fee of RS.3000 to the department on May 2017.
For about 15 days, no action was taken by the ED. When he approached the ED, he was told that there was no stock of the appropriate cable and so he was asked to produce the cable and he bought the same from his own pocket and got the meter installed.

Nareshjith Singh made a complaint on the ED for their inert behaviour with the complainant. In the reply, the ED said that the complainant was asked to wait for sometime but he was adamant. So he was asked to buy the cable and the cost was adjusted by the ED later.
The Consumer Forum observed that the ED has failed to prove that the complainant was asked to buy the cable for the sake of installation of the meter. The ED has failed to fullfill its duty towards the complainant. The forum in its award directed the Executive Engineer and the Sud- Divisional Officer of the ED to pay RS.10,000 as compensation to the complainant.

These are the basic consumer rights that every consumer is vested within himself or herself that nobody can alienate. Rights are always correlated with duties. The seller or the service provider has the duty towards their consumers to ensure that they are provided with the quality good or service.

In this case, the ED has literally failed to fullfill its duty towards the consumer alias the complainant.
