Haryana Rera Orders Refund at 10.45 Rate of Interest

Yet again a builder has been penalised for not fulfilling the commitment of delivering possession on time by Haryana RERA Authority.

The builder this time is Supertech Limited , a reality company based out of Gurgaon.

The possession was to be delivered in June 2018 including 6 months grace. The defaulting Real Estate company has done nothing in the project except making structure.

The project is nowhere set to be completed till 2020. In this situation the complainant sought refund of the amount plus interest and compensation for delay.

RERA Act stipulates rate of interest in case of a delay in possession which is SBI MCLR plus 2 % that comes out to be 10.45% for the present case.

What irked the Authority most was the fact that the company accepted pre booking amount even before getting sanction from the competent Authority which is against the settled principles of RERA law .

Further the Authority went onto say that company has played fraud upon the consumers and cheated them of their hard earned money.

The complainant has paid almost 76 lacs which is now to be refunded along with 10.45 rate of interest.

Builder floated this project in 2014 and the agreement to sell was executed on June 2014 despite of the fact pre booking amount was given in 2013.

HRERA Authority has once again ordered refund keeping home buyers interest of paramount importance .
