Income-tax Officers Promotion Debunked by Cat Tribunal Chandigarh

Applicants who were 10 in number were initially recruited as Inspectors through Combined Graduate Level Examination and joined different regions between 2011 & 2013.Later these 10 individuals applied for inter-charge transfer ( ICT) to chief commissioner of income tax Chandigarh in north west region on different dates as per circular dated May 14, 1990.

Competent Authority accepted ICT request of these 10 I-T officers and passed the orders of transfer where it was specifically said that they will lose seniority in the new region and will be given bottom seniority. Further, they forfeit all claims of regularization, confirmation or promotions in the old region.

The inspectors who have now approached the CAT Chandigarh had made the claim to I-T department regarding re-fixing of seniority and promotion by giving the benefit of earlier service rendered which was rejected. Also the seniority list dated August 21, 2015 was challenged in the original application (O.A.).

In the O.A. the applicants had claimed the relief for parity with their batch mates of Staff Selection Commission – Combined Graduate Level (SSC-CGL) batch in the same recruitment year.

Their main grievance was that they were not given seniority nor consequential benefits vis-à-vis other persons who were selected along with them and allocated the north-west region.

The next level after an inspector is that of an Income-Tax officer governed by Group B Posts Recruitment (Amendment ) Rules ,2005 where it mentions I-T inspector in pay grade of Rs. 6,500-Rs.10,500 with three year regular service and has qualified department examination for income-tax officer are qualified for consideration.

Department was given various representations regarding promotions made in the year 2014-2015 based on the aforesaid 2005 rules where juniors to these 10 individuals were promoted.

Based on these promotions, seniority list was prepared on August 21, 2015 that too was under Challenge. As these 10 individuals knowingly choose ICT over seniority/promotions, their plea lacked merits as observed by Central Administrative Tribunal Chandigarh.
