War Injury Pension Arrears Allowed by Aft Tribunal

What could be termed as ‘stonehearted fashion’ while noting the contention of central government, in a proceeding before AFT  Tribunal Chandigarh, a retired Army veteran got his dues after a long gap of 40 years i.e. War Injury Pension (WIP) from 1978 to July 2013.

The argument before the tribunal by central government was that since the veteran applied in the year 2013 only for WIP , he should be entitled from 2013 only which was denied by bench and termed as ‘flabbergasted”.

Major Jasbeer Singh (retired) an army veteran who lost a leg and an eye in a mine blast in 1966 in Sikkim (Indo China-Border) took the matter to authorities via representation in Nov 2012, July 2013 & Dec 2013. He rested his claim on government order dated 19 Aug 2016 that he says entitled him for WIP. Singh retired from the service on 1978 and was awarded Sena Medal (Gallantry). The injury suffered by Mr. Singh was declared as ‘Battle causality’ by the army.

Even though the army veteran was paid WIP for 2013 to 2016, his claim was to be ascertained from 1978 to 2013 and this was the reason behind why central government was rapped by the AFT Chandigarh bench for its lackadaisical attitude.

AFT Chandigarh held that the Army veteran was entitled for WIP from date of his invalidation of retirement not from his legal representation.

Tribunal entitled him to recover arrears of WIP from Sept 1978 to July 2013 @ 9% annual interest rate till the date of actual payment.

Even litigation cost to a tune of 30 K was compensated by the AFT Chandimandir Bench to the veteran.
