MACT  simply means motor accident claims tribunal. Mact deals with matters related to compensation of motor accidents victims or their next of kin. The tribunal deal with claims relating to loss, life , property and injury cases resulting from motor accidents. Mact courts are presided over by judicial officers from the state higher judicial service. Now these courts are under direct supervision of the hon’ble high court of the respective state.

The motor vehicles act 1988 is an act of the parliament of India which regulates all the aspects of road transport vehicles. This act came in force from July 1989.

THERE ARE TWO FACTS IN THE CIRCUMSTANCE

WHO CAN REPORT TO MACT IN CASE OF ACCIDENT?

Victim himself or through  advocate in the case of personal injury. Through advocate in the case of minor applicant below the age of 18 years. Legal heirs themselves or through advocate in the case of death. The owner of the vehicle in the case of property damage.

WHAT IS SECTION 166 OF MOTOR ACT?

Section 166 of Motor vehicle act deals with how an application for compensation has to be made. It only talks about things like the persons eligible to file an application for compensation. How it should be filled etc. the claim has to be filed with the relevant motor accident claims tribunal (mact).

IS TRIBUNAL A COURT? WHAT IS TRIBUNAL?

Tribunals are specialist judicial bodies which decide disputes in a particular area of law. Most tribunal jurisdictions are part of a structure created by the courts and enforcement act 2007. Tribunal hearings take place in a variety of settings including specific tribunal hearing rooms or informal court rooms. Although administrative tribunals may resemble courts because they make decisions about disputes they are not part of the court system. Administrative tribunals are set up to be less formal, less expensive and a faster way to resolve disputes than by using the traditional court system.
