Punjab DGP’s (Director General of Police) appointment under challenge in CAT (Central Administrative Tribunal), Chandigarh.

DGP Dinkar Gupta’s appointment is under challenge in CAT, Chandigarh by DGP Mohammad Mustafa (head of Punjab’s anti-drug special task force) and Siddharth Chattopadhyaya, a 1986-batch officer.

Facts of the case
Mohammad Mustafa moves the tribunal alleging that he was ignored by UPSC (Union Public Services Commission) despite of fulfilling all the criteria. He alleged that the state also does not support his candidature while preferring Dinkar Gupta. Both the petitioners also challenged the UPSC’s recommendation of three junior officers over them. The record of UPSC doing empanelment of the candidates is also sought by the petitioners.

The news of Defence Minister AK Antony’s office being bugged in March, 2012 has also been referred to where Gupta was the IB then. Gupta was then unceremoniously removed and repatriated to Punjab.
The petitioner’s argument is that both Dinkar Gupta and former DGP Suresh Arora were in nexus with drug traffickers and that he was not the right fit for the job as per the sealed report given in the High Court of Punjab and Haryana.

Since the police authority comes under the aegis of the centre, thus appointments can be challenged before the Central Administrative Tribunal (CAT) at Chandigarh, located opposite Hotel Shivalik View.
