Punjab Education Tribunal deals with the service matters of Teachers and staff of Schools and Colleges being run on government aid in Punjab. As per Supreme Court decision in TMA Pai’ Foundation & Ors vs.  State of Karnataka in 2003, the court ordered to set up an Educational Tribunal in each district of a State. The Punjab Educational Tribunal framework governs service conditions, disciplinary control, and dispute resolution for employees of privately managed and aided educational institutions in Punjab. The law primarily protects teachers and staff from arbitrary actions by management.

The Punjab Privately Managed Recognized Schools Employers (Security of Service) Act, 1979 has been amended by Punjab Government to bring Private unaided Schools under Educational Tribunal constituted in 2008.

  • Retirement age: 58 years (aligned with government norms where applicable).

  • Provisions exist for earned leave, casual leave, maternity leave, and subsistence allowance during suspension.

  • Management can be penalised for non-compliance with Tribunal orders.

  • In aided institutions, grant-in-aid can be affected for violations.

Punjab & Haryana High Court at Chandigarh has also settled the law on the jurisdiction of the Punjab Education Tribunal that all dispute between the management and employers would lie before the tribunal except in cases of gratuity to be paid under the payment of gratuity Act.

Punjab Educational Tribunal was made to redress grievances of both aided & unaided education institutions in Punjab for matters pertaining to punishment or termination of service. Also one can seek remedies in case of dismissal, removal, reduction in rank, retirement benefits, pension, payment of leave encashment, arrears of pay etc.

Once a matter falls under the Tribunal’s jurisdiction:

  • Civil Courts cannot entertain such disputes

No petition is maintainable before Education Tribunal Punjab against the order of DPI (Director Public Instruction) for unaided post as settled in CWP- 22676-2010 & CWP-20575-2011. You can view on the order on the High Court website.

The same remedy is available to employees to approach the Education Tribunal u/s 7(12) of the Punjab Affiliated Colleges (Security of Service of Employers) Act, 1974.

Undoubtedly, Punjab Education Tribunal can be approached by Employers of Private/Government/ aided/ unaided educational institutions, Schools, Colleges to avail cost effective and speedy redressal of grievances and complaints in all service matters.

For the State of Haryana Educational Tribunal, it is settled in the case no. CR 4315 of 2012, titled Management SD School vs. District Judges decided on 27.11.2013 by J.Hemant Gupta & Fatehdeep Singh that only Educational Tribunal can hear service matter disputes after their formation in the State and for that Haryana School Education Act, 1995 may kindly be amended.
