This was the first question that people asked when RERA was introduced.
What’s going to happen with pending complaints? Would consumer courts stop entertaining the complaints against builder? The answer was No. Fortunately!

It was left at the option of consumer to choose the platform of redressal. Sec 71 of RERA Act 2016 allows consumer to withdraw pending complaint before consumer forum with liberty to file afresh before RERA Authorities.
But the ground reality is different. Maintainability of complaint before RERA was unexplained. Thus many complaints went dismissed on ground of maintainability.
As on today, the projects not registered are not maintainable before RERA. The thin line of interpretation is left for the ongoing projects where state purposely has left selective projects out of ambit of RERA.
Further where the project has got partial occupancy certificate /completion certificate, then also that project is out of ambit of RERA.
For the new portion or the remaining part of the project which is not registered, complaint before RERA is maintainable.

What attracts home buyers / flat owners towards RERA is 60 days window within which the complaint is meant to be decided or authority has to record reasons for extension.
RERA is a new ray of hope for stressed out home buyers who are buying the house for the first time and needs timeline to be followed while handing over the possession.
