In case of Hospital Engineer, Central Administrative Tribunal (CAT) Chandigarh has directed PGIMER ( Post Graduate Institute of Medical Education & Research ) to escalate the process of consideration of all eligible candidates.
The case came to the CAT Tribunal Chandigarh when PGI removed one Assistant Engineer from RAC (Refrigeration & Air conditioning ) vide order dated Aug, 16 2018.

Timeline
1 Applicant joined as Junior Engineer in RAC in July 13, 1989.
2 Got promoted to Assistant Engineer on June 21, 2010.
3 The next Promotion is of Hospital Engineer (RAC) as the eligibility is 7 years of Service as Assistant Engineer and service remark ‘Good’.
4 Inspite of availability no regular promotion and only current duty charge is being given.
Issue
PGI Authorities has given the charge to one officer junior to the applicant that made him approach the CAT, Chandigarh. PGI also moved for Stay Application.

Reason for Change
The Competent Authority found applicant negligent and irresponsible. After various warnings also the applicant didn’t improved.
Also when the charge was withdrawn, applicant was inelligible for promotion.

Reasoning by CAT Chandigarh
Applicant eligible from June 2017 but due to DPC (Departmental Promotion Committee) being conducted prior can’t materialise the request.
