Sexual Harassment Case in Cat Tribunal

The CAT has issued notice to Chandigarh police to defer proceedings on a sexual harassment case against a traffic DSP, after he had moved to CAT seeking the same.

Sondhi was a traffic DSP and he  was alleged by a woman officer that he sexually harassed her by demanding her to accompany him in his house. The woman officer had complained after the DSP repeatedly tortured her by demanding to accompany him.

An Internal Complaint Committee was framed to deal with the complaint against the alleged DSP which decided he was guilty. It was found by the ICC that the DSP has manipulated the records of the complainant to create a fake misconduct charge over the complainant.

In the mean time, the DSP approached the CAT and stated that there was no merit in the said allegation and his name had been cleared thrice in the same issue. The CAT on hearing the DSP has issued a notice to Chandigarh police ordering it to defer the proceedings against the DSP.

Today, India is facing a lot of sexual harassment allegations against men, as a result of the success of the historic #metoo campaign. Men who harass women need to be named by the victim and shamed by the law through a deterrant punishment. More stringent penal laws for sexual harassment is the need of hour.

This move by the CAT comes at a time where every day disclosures about exploitation of a woman at workplace is a thing to worry and courts intervention in this matter may impact the outcome for sure.

For now, UT Police is directed not to proceed further till next date of hearing which is November 20, 2018.
