Soon a Law for Love Marriage Protection

Last Updated on June 10, 2024 by Satish Mishra

Supreme Court in a pending matter before it concerning protection of couples who have married against the wishes of their parents has reaffirmed that no person can threat , injure or interfere in lives of a couple once married whether or not married outside their caste or faith.

Petition filed by centre demands for special police unit in each district of country to investigate offences related to honour killing and extend protection to those fearing life and live under distress.
In reply government has further submitted that it will enact a law that makes “honour killing” a cognisable offence. Since law and order is a state subject response is sought from all states and 23 out of them have already responded leaving 6 to still give suggestions.

Until then police authorities will keep taking appropriate actions under IPC.

Centre in this case is seeking directions from apex court to states to look into complaints of harassment by married couples and let the investigation be done by officer not below the rank of DSP failing which disciplinary action should be taken officers who are found in dereliction of duty.

Bench comprising of CJI, Deepak Mishra was hearing the case filed by Shakti Vahini, NGO against the diktats  khap panchayats threatening couples with dire consequences if they marry against wish, caste or customs prevailing. Bench is yet to filed detailed judgment on this case pending since 2010.

It is often seen that punishments given by khaps leads to ostracisation of the couple making them commit suicide.

Counsel for Centre , Pinky Anand pushed couples to inform marriage officer about these threats while registering marriage.

Government must provide protection homes or security to the couple seeking shelter under threats. Necessary support and assistance is warranted in these critical situations.

LegalSeva surely awaits the new change and prays that the life of Couples Seeking Protection from Punjab and Haryana High Court or District Courts in Chandigarh, Panchkula, Mohali and Kharar be safeguarded and protected.
