In this post we will discuss about the recent order of district consumer dispute redressal forum in which it directed a travel form to pay compensation to the complainant for failing to cancel the ticket and refunding the money.

Facts of the case  : the brief facts of the case can be discussed as under :

Vishal Bhardwaj, a resident of sector 38 Chandigarh book air tickets from Chandigarh to Lucknow with departure dated January 28, 2019 and the return ticket dated January 30, 2019 on December 18 2018. After completing the booking complainant realised that he has booked the tickets for wrong date and therefore it right to modify the same from mobile app but could not succeed. Thereafter he called the customer care helpline but the date could not be changed and the complainant was informed that no flight was available. Where as according to complain and the app should multiple flight available for fresh booking. Alleging that aforesaid act amount to deficiency in service and unfair trade practice on their part hi file a consumer complaint. The form valid meeting the basic facts of the case pleaded that it provide the facility for booking flight tickets. The actual service providers are the airline. On the receipt of payment of rupees 44,975 the booking was successful and an  e- ticket bearing trip ID 1812 1834 7262 was sent to the email of the complainant. On December 18 2018 the complainant contacted the customer support team and informed that he had mistakenly book tickets for January 28,  2019 to January 30 2019 instead of booking for December 28 to December 30 2018 the customer support executive assisted the complainant to amend the booking for the desired date but could not find any flight the support executive also inquired with the complainant on the flexibility of the day but he refused to travel on other dates.

Legal provisions related : Consumer protection act 1986 ( now it has been amended by 2019 act )

The main legal issue involved in the case is :

Whether the clear trip pvt. ltd is liable to compensate the complainant for the deficiency in service ?

Decision of the district consumer forum :the forum after hearing both sides held that all the company in it reply itself admitted that the complainant contacted the customer support team on December 18, 2018 get know where the company stated that on account of non availability of flights for the preferred date it has desired the complainant to cancel the ticket. It is also not the case of company that it has processed the request of the complainant for refund but the same was declined as per terms and conditions applicable thereto. At any rate when the complaint and did not intend to travel on any other date and insisted the booking to be amended for December 28  to December 30, 2018 for which no flights were available the company or to guide the complainant to cancel the ticket and thereafter to process the refined coat with which it miserably failed to do and prepared this unwarranted uncalled for litigation upon the complainant.

Thus the forum directed Clear trip  private limited to pay 10,000 as compensation for failing to cancel tickets booked by complainant for wrong date and refunding the money they were also directed to refund rupees 44,975 to the complainant.

Conclusion : Thus in the above case the district consumer forum directed the travel firm to compensate the complainant for deficiency of service and also directed it to refund the amount of air tickets which is  an adequate remedy and relief granted by the forum.
