RELIEF OF RS.13L AWARDED TO MAN BY THE CONSUMER FORUM AFTER HE WAS DECIEVED BY AN IMMIGRATION CONSULTANCY

De Montreal Recruitment Limited is a Chandigarh based immigration consultancy. Varinder Singh has approached this firm in 2016 through their website , paid Rs. 12.4L and later deposited relevant documents and his original passport for getting the work permit to Canada. The firm closed eventually and Varinder lodged an FIR in the police station that was to no avail. He then approached the District Consumer Dispute Redressal Forum, Chandigarh.

The forum observed that the firm has undergone an Unfair Trade Practice and awarded Rs. 13L as compensation to be paid by the firm.

Unfair Trade Practice(UTP) involves false advertisement based on irrelevant facts, fraudulently using the trademarks of well known brands, giving false promises to attract consumers, etc.

Remedies on UTPs

Removal of the defect pointed out by the appropriate laboratory from the goods.
Replacement of the goods with the new goods of similar description, which are free from similar defects.
Refund to the complainant.
Compensation to the consumer for any loss or injury suffered by the consumer due to the negligence of the opposite party.
Removal of the defects or deficiencies in the services in question;
Discontinuation of the unfair trade practice or the restrictive trade practice or not to repeat.
Not to offer the hazardous goods for sale.
Withdrawal the hazardous goods from being offered for sale and
To provide for adequate costs to parties.
