Retirement Benefits Denied. Court Orders Attachment of Vehicle of Director

In 2015, court ordered Haryana Transport department to grant third ACP scale along with interest on leave encasement delayed amount to the petitioner Mr. Suraj Bhan.

Department failure to comply with the orders lead court to pass directions to attach official vehicle of the Director General of Haryana Transport Department. An amount of Rs 5 Lakh as compensation was awarded to Mr. Bhan as part of benefits that were denied in April 2015.

Mr Bhan joined as a conductor on Jan 1, 1979 and retired in May 31, 2011. His pay scale was revised from rs.1200-2400 to rs 4000-6000 from Jan 1, 1996. Again promoted to Sub Inspector on July 3, 2002 in pay scale of Rs 5800-7850 but his pay scale was not upgraded.

As per Haryana Revised Pay Rules -2008, his pay scale was revised to Rs 9300-34800 from Jan 1, 2006.

The problem came as the rules were in conflict with the act. As per Act third ACP on 30 years of service and 10 years of second ACP scale. There were no adverse remarks in the ACR (annual confidential report) of Mr. Bhan.

Mr. Bhan was to get entire amount of Leave encashment, and pension benefits on the retirement which was not given.

Department in his defence told court that Mr Bhan’s six increments were stopped and three disciplinary proceedings were initiated against him which eventually led to termination in December 1993. However Mr. Bhan was reinstated in August 1995.

In 2015, the case was decided in Bhan’s favour where court ordered Haryana Transport Department to grant third ACP scale along with interest on delayed payment of leave encashment.

Failure to comply with 2015 orders irked the court and finally led to attachment orders of car of DG of Haryana Transport Department.
