Therefore, under Section 43(4) of Real Estate (Regulation & Development) Act, 2016, the governor of Himachal Pradesh is pleased to confer the power and jurisdiction upon Haryana Real Estate Appellate Tribunal at Karnal to hear appeals preferred against the decisions or orders of Real Estate Regulatory Authority, Himachal Pradesh and the Adjudicating Officer, under the ibid Act of 2016.

Appeals from both orders of Authority and Adjudicating Officer of Himachal Pradesh RERA Authority will come to RERA Appellate Tribunal Haryana at Chandigarh.

Like the mandate of Haryana RERA Appellate Tribunal, pre-deposit is a must for Himachal RERA Appellate Authority as well under Section 43(5) of RERA Act. The Himachal Pradesh High Court at Shimla has already cleared this in many of the case. One such is here for your perusal. Atleast 30% is a must to entertain the appeal before RERA Appellate Authorities be it Haryana, Punjab or Himachal Pradesh.

In view of the above it is submitted that the Haryana Real Estate Appellate Tribunal is already operational and at present having its office at SCO No. 50-51, (4th. Floor), Sector 17–A, Chandigarh. Therefore, all the appeals against the directions/orders/decisions of the Real Estate Regulatory Authority, Himachal Pradesh and the Adjudicating Officer may be filed/submitted in this Tribunal at the above mentioned address. Wide publicity in this regard be given in the leading newspapers also to aware the litigants, interested persons and the Advocates.
Your next question would be- Will the appeal from RERA Appellate Authority Himachal Pradesh will go to Punjab and Haryana High Court? The answer is no. Still it would go to Himachal Pradesh High Court at Shimla.
