Facts of the Case:

  1. That the recommendations of the Co-ordination Committee, constituted for the purpose of examining the aspect of restructuring of stagnated cadres in the PGIMER, Chandigarh, at par with AIIMS New Delhi and JPIMER Chandigarh, qua the cadre of the applicants have already been forwarded by Respondent No. 1 to Respondent No. 2 vide communication dated 03.08.2016 and after examination by Respondent No. 2, it was again forwarded to Respondent No. 1 vide communication dated 13.11.2018.

He submitted that the relevant benefit has already been granted to cadre of Physiotherapist under the same department of Physical and Rehabilitation Medicine under which the cadre of applicants also falls.

It is alleged that the respondents have discriminated against the category of applicants i.e. Occupational Therapist.

That a representation dated 24.08.2018 has been filed by the applicant to Respondent No. 2 to grant the relevant benefit of the recommendations of the Coordination Committee which has been replied to vide letter dated 20.11.2018.

That the matter is under consideration with Respondent No. 1. He, therefore, suffered a statement that the applicants would be satisfied if a direction is issued to Respondent No. 1 to do the needful within a time bound manner.

Judgment:

Considering the short prayer made on behalf of the applicants, coupled with the fact that the case of the applicants for restructuring has already been recommended by the Coordination Committee, the O.A. is disposed of, with a direction to Respondent No. 1 to take a decision with regard to the cadre restructuring of the applicants expeditiously, in any case, not later than four months from the date of receipt of a copy of this order.

Needless to mention that the disposal of the O.A. shall not be construed as an expression of any opinion on the merit of the case. No costs.
