Core Components of a Consumer Complaint

  • Memo of Parties: Clearly state the names, addresses, and descriptions of the Complainant and the Opposite Party (OP).
  • List of Dates and Events: A chronological, concise list detailing when the product/service was purchased, when the defect occurred, and when the complaint was made.
  • Body of the Complaint:
    • Facts: Detailed explanation of the transaction, the promise, and the deficiency.
    • Jurisdiction: Specify how the court has pecuniary and territorial jurisdiction.
    • Cause of Action: Explain when and how the dispute arose.
  • Prayer Clause: Clearly define the relief sought (e.g., refund, compensation for mental agony, litigation costs).
  • Affidavit: A sworn statement by the complainant verifying the facts, attached as an affidavit in support of the complaint.

Essential Steps and Checklist

  1. Legal Notice: Send a formal notice to the opposite party before filing to establish a, “refusal to correct”.
  2. Supporting Documents (Annexures): Attach photocopies of receipts, warranty cards, correspondence, and emails, labeled as “Annexure A,” “Annexure B,” etc..
  3. Limitation Period: Ensure the complaint is filed within two years from the date the cause of action arose.
  4. Formatting: Use a formal structure (Before the District/State/National Commission), clear paragraphing, and precise, polite language.
  5. Signature: The complaint must be signed by the complainant or their authorized representative.
