This post is a judgment digest of Haryana RERA Panchkula Complaint against Piyush Buildwell wherein the builder demanded higher amount for conveyance deed which was not as per agreed terms of builder buyer agreement. Hence court directed to take reasonable amount for getting conveyance deed done.

In combine case of Amit Mehra and 68 other complainants vs. Piyush Buildwell in Panchkula. Haryana RERA Panchkula authority had disposed it with a common order directing the respondents to pay the conveyance deed within 45 days of publishing this order on portal of the website.

BRIEF FACTS:-

  • Complainants purchased the apartment on the project Piyush heights of the respondent located at sector-89, Faridabad.
  • All the 69 complainants case were same so for taking a case and for knowing the facts a leading case of Amit Mehra vs. Piyush buildwell is taken into consideration.
  • The complainant allotted flat C-413 on 27 Nov. 2006
  • The builder-buyer agreement was signed on 02.08.2007
  • The complainant regularly paved all the installments and upto05.12.2017 he had completed the amount of Rs.33,40,901.10 against the projected price of Rs.25,22,695.00.

  • An offer of possession from the builder was given to them after fulfillment of certain conditions.
  • The prayer of the complainant are that even after receiving possession and clearing all the dues the builder is not giving conveyance deed on their favour.
  • The respondent is charging some additional amount of Rs.3,52,000 including stamp duty and registration fees.
  • The respondents are even not filing their reply after first bunch of 46 notices.

JUDGEMENT:-

As a result the complaint is accepted and respondents are directed to pay the conveyance deed within 45 days of publishing this order on portal of the website by assigning a senior officer of the company to all 69 complainants.
